1. The provisions of this agreement shall govern the accommodation contract and related agreements concluded between this accommodation facility and guests. not provided for in this agreement shall be governed by laws or generally established customs.
2. If this accommodation facility agrees to special terms within the limits permitted by laws and customs, such special terms shall take precedence over the provisions of the preceding paragraph.
(Application for an Accommodation Contract)
Article 2
1. Individuals intending to make an application for an accommodation contract with this accommodation facility shall provide the following information to this accommodation facility:
(1) Name of the Guest(s)
(2) Date of accommodation and expected time of arrival
(3) Accommodation fee (primarily based on the basic accommodation fee specified in Appendix 1)
(4) Other information deemed necessary by this hotel
2. If a guest wishes to extend their stay beyond the accommodation date specified in the preceding clause, the accommodation facility will consider their request as a new application for an extended accommodation contract at the time the request is made.
(Conclusion of Accommodation Contract, etc.)
Article 3
1. The accommodation contract is concluded when this accommodation facility approves the application outlined in the preceding article. Nevertheless, this is not applicable if the accommodation facility can substantiate the non-approval of the application.
(Refusal of Accommodation Contract)
Article 4
1. This accommodation facility may refuse to conclude an accommodation contract under the following circumstances:
(1) When an application for accommodation does not comply with this agreement.
(2) When there is no room available due to full occupancy.
(3) When there is a recognized concern that the individual intending to stay may engage in conduct contrary to legal regulations, public order, or good morals concerning accommodation.
(4) When the guest falls under any of the following:
A member of an organized crime group as defined in Article 2, Paragraph 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991), an organized crime group member as defined in Article 2, Paragraph 6 of the same Act, a quasi-member or affiliate of an organized crime group, or any other antisocial force.
When an organized crime group or a member of an organized crime group dominates a corporation or other organization.
When there are individuals among the officers of a legal entity who qualify as members of organized crime groups.
(5) When the guest behaves in a manner that causes significant disturbance to other guests.
(6) When the guest is recognized as a carrier of an infectious disease.
(7) When there is any form of aggressive or violent demand related to accommodation or when excessive responsibilities beyond a reasonable extent are imposed.
(8) When natural disasters, facility malfunctions, or other unavoidable circumstances prevent the provision of accommodation.
(9) When it falls under the provisions of Article [__] of the Prefectural Ordinance.
(Contract Termination Right for Guests)
Article 5
1. Guests are entitled to terminate the accommodation contract by notifying the accommodation facility.
2. If guests terminate all or part of the accommodation contract for reasons attributable to them, this accommodation facility will charge a penalty fee as specified in Appendix 2.
3. If guests fail to arrive by 3:00 PM on the day of their reservation (or by 6:00 PM with prior notification), this accommodation facility reserves the right to deem the accommodation contract as canceled by the guests and process it accordingly.
(Contract Termination Rights for Accommodation Facility)
Article 6
1. This accommodation facility may terminate the accommodation contract in the following cases:
(1) When the guests are likely to engage in actions that violate laws, public order, or good morals concerning accommodation, or when such actions are confirmed.
(2) When the guest is determined to fall under any of the following conditions:
Belonging to organized crime groups, gang members, quasi-members or affiliates of organized crime groups, or other antisocial forces.
When an organized crime group or a member of an organized crime group dominates a corporation or other organization.
When there are individuals among the officers of a legal entity who qualify as members of organized crime groups.
(3) When the guest behaves in a manner that causes significant disturbance to other guests.
(4) When the guest is identified as a carrier of an infectious disease.
(5) When there is any form of aggressive or violent demand related to accommodation or when excessive responsibilities beyond a reasonable extent are imposed.
(6) When natural disasters, facility malfunctions, or other unavoidable circumstances prevent the provision of accommodation.
(7) When the guest engages in prohibited activities as outlined in the accommodation facility's rules of use, including but not limited to smoking in non-designated areas within the sleeping quarters, tampering with fire prevention equipment, and other actions against the facility's specified rules (restricted to particulars deemed necessary for fire prevention).
(Registration)
Article 7
1. Guests shall provide the following information at the front desk of this accommodation facility on the day of accommodation:
(1) Guest's name, age, gender, address, and occupation
(2) For foreigners: nationality, passport number, port of entry, and date of entry
(3) Departure date and expected departure time
(4) Any other information deemed necessary by this hotel.
2. If a guest intends to make payment for the charges specified in Article 11 using an alternative method such as a credit card, they shall present those during registration as mentioned in the preceding paragraph.
(Occupancy Hours of Guest Rooms)
Article 8
1. Guests can use the guest rooms of this accommodation facility from 2:00 PM until 10:00 AM the following morning. However, in the case of consecutive stays, excluding the arrival and departure days, guests can use the rooms throughout the day.
(Compliance with Rules and Regulations)
Article 9
1. Guests are to adhere to the rules and regulations posted within the hotel premises, as set forth by the hotel.
(Business Hours)
Article 10
1. The business hours of the main facilities of this accommodation facility are as follows, and detailed business hours of other facilities will be provided in brochures, postings at various locations, service directories in guest rooms, etc.
(1) Front desk and cashier service hours: 9:00 AM to 6:00 PM.
(2) Food and beverage (facility) service hours: For consecutive stays, meal service times for the following day will be confirmed between the guest and the accommodation facility.
2. The hours specified in the preceding paragraph may be temporarily changed when deemed necessary. In such cases, guests will be duly informed.
(Payment of Accommodation Fee)
Article 11
The breakdown of the accommodation fees to be paid by guests shall be as specified in Appendix.
2. The payment of the accommodation fees in the preceding paragraph shall be made by currency or any other method approved by the accommodation facility when guests depart or when requested by the accommodation facility at the front desk.
3. Accommodation fees will be applicable even if a guest voluntarily does not stay at the accommodation after the accommodation facility has provided a room to the guest and made it available for use.
(Liability of the Accommodation Facility)
Article 12
1. The accommodation facility shall compensate the guest for damages caused by the performance or non-performance of the accommodation contract and related contracts. However, this does not apply when the reasons for such damages are not attributable to the accommodation facility.
2. In the event of fire or other unforeseeable disasters, the accommodation facility is covered by Hotel Liability Insurance.
(Handling when unable to provide Contracted Room)
Article 13
1. In cases where this accommodation facility cannot provide the guest with the contracted room, the facility shall seek the guest's agreement and make arrangements to secure the best alternative accommodations under similar conditions.
2. If, despite the provisions in the preceding clause, this accommodation facility is unable to secure alternative accommodations, they will compensate the guest with a penalty fee equivalent to the damages. This compensation fee will offset the total compensation amount for any damages incurred. However, in cases where the inability to provide the room is not attributable to the fault of this accommodation facility, no penalty fee will be paid.
(Handling of Deposited Items)
Article 14
1. This accommodation facility does not accept the deposit of items from guests.
2. If, due to the deliberate or negligent actions of this accommodation facility, loss, damage, or any harm occurs to items, cash, and valuables brought into the facility by guests, this accommodation facility will compensate for the damage. However, this accommodation facility will compensate for damages up to a maximum of 300,000 yen for items for which the type and value were not previously declared by the guest, except in cases where this accommodation facility is deliberately or grossly negligent.
(Custody of Guest's Baggage or Belongings)
Article 15
1. If a guest leaves behind their baggage or belongings after checking out, this accommodation facility shall handle them in accordance with the extent permitted by law as follows:
(1) Cash: After being held at the accommodation for 7 days, including the time of discovery, the cash will be reported to the nearest police station.
(2) Food and beverages, fresh flowers, perishable items, and items emitting odors: They will be disposed of on the day of discovery regardless of their price or expiry date.
(3) Other items: After being kept in the accommodation facility for a period of one month, including the day of discovery, they will be disposed of.
2. To appropriately handle left-behind baggage or belongings in accordance with their contents, this hotel reserves the right to inspect their contents as necessary and, if necessary, at its discretion, return them to the owner or dispose of them according to the provisions in the preceding paragraph. Guests are not entitled to raise objections to this.
3. The responsibility of this accommodation facility for the custody of guests' baggage or personal belongings in the case mentioned in the preceding p aragraph shall be in accordance with the provisions of the preceding Article, paragraph 2.
(Parking Liability)
Article 16
1. When a guest chooses to utilize the parking facility of this accommodation, regardless of whether they have entrusted their vehicle keys, the accommodation facility is providing the parking space for rent but does not bear the responsibility for vehicle management. However, if the accommodation facility causes damage due to deliberate or negligent actions in managing the parking facility, it will be liable for compensation.
(Liability of Guests)
Article 17
1. If this accommodation facility incurs damages due to the intentional or negligent actions of a guest, that guest is obligated to compensate this accommodation facility for said damages.
Article 18
1. Breakdown of Accommodation Fees, etc., as stipulated in Appendix 1 (Related to Article 2, Paragraph 1, and Article 11, Paragraph 1).
